These Terms of Use (“Terms”) govern your access to and use of https://kdevinehomes.com and its pages, property-search features, forms, calculators, content, and related functionality (collectively, the “Website”). The Website is maintained for Team Devine, a real estate team led by Kim Devine and affiliated with The Real Estate Studio (“Team Devine,” “we,” “us,” or “our”).

By accessing or using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website.

1. Informational Purpose Only

The Website provides general information about Team Devine, real estate services, communities, and properties. Website content is not legal, tax, financial, lending, appraisal, inspection, engineering, or other professional advice. You should consult appropriately qualified professionals before making a real estate, financial, or legal decision.

We may change, correct, suspend, or remove Website content or functionality at any time without notice. We do not guarantee that Website content is complete, current, accurate, available, uninterrupted, or suitable for a particular purpose.

2. No Brokerage or Agency Relationship Through Website Use

Visiting the Website, viewing a listing, using a calculator, sending an email, submitting a form, or communicating with Team Devine through the Website does not by itself create a brokerage, agency, fiduciary, client, or other professional relationship.

A real estate brokerage or agency relationship is created only through the disclosures, agreements, and other steps required by applicable law and brokerage policy. Any signed brokerage agreement, transaction document, or other specific agreement will control if it conflicts with these general Terms.

3. MLS/IDX Property Information

The Website displays Internet Data Exchange (“IDX”) information provided through Multiple Listing Service, Inc. and participating real estate brokers. Realtyna/RealtyFeed supplies technology used to display listing data on the Website. The Real Estate Studio is the IDX participant associated with the Website.

The listing information contained on the Website is provided solely for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing.

Listing information is supplied by sellers and other third parties and has not been independently verified by Team Devine. Listings may contain errors, omissions, or delays, and property price, availability, status, features, measurements, square footage, acreage, room dimensions, boundaries, schools, taxes, assessments, zoning, and other information may change without notice. Photographs may not reflect a property’s current condition.

You must independently verify material information before relying on it or making a purchase, sale, financing, or other decision. A listing displayed on the Website is not an offer or guarantee that the property remains available.

All MLS/IDX notices, brokerage attribution, listing-courtesy statements, data-source notices, and copyright notices displayed with listings or in the Website footer are incorporated into these Terms.

4. Calculators and Estimates

Any mortgage, payment, affordability, valuation, or other calculator or estimate available on the Website is provided for general illustrative purposes only. Results may rely on assumptions and may not include taxes, insurance, fees, assessments, closing costs, rate changes, eligibility requirements, or other relevant expenses. Calculator results are not a loan offer, credit decision, appraisal, valuation, financial advice, or guarantee. Consult a qualified lender or other professional for information specific to your circumstances.

5. Fair Housing

Team Devine supports Equal Housing Opportunity and provides real estate services in accordance with applicable federal, state, and local fair-housing laws. Team Devine does not discriminate in housing-related services on a basis prohibited by law.

6. Permitted Use

You may use the Website only for lawful, personal, non-commercial property-search and legitimate real estate inquiry purposes.

You may not:

  • Copy, scrape, crawl, harvest, download in bulk, republish, sell, license, or create a database from Website or MLS/IDX content;
  • Use automated means to access the Website except as expressly authorized;
  • Interfere with Website operation, security, access controls, or another user’s use;
  • Attempt unauthorized access to the Website, accounts, servers, or connected systems;
  • Introduce malicious code, viruses, or harmful technology;
  • Submit false, misleading, unlawful, infringing, or fraudulent information;
  • Impersonate another person or misrepresent your identity or affiliation;
  • Use Website content to create or support a competing listing service, product, or database; or
  • Use the Website in a manner that violates law, MLS rules, third-party rights, or these Terms.

7. Accounts and Saved Features

If account registration, saved properties, saved searches, alerts, or similar features are made available, you are responsible for providing accurate information, safeguarding your login credentials, and promptly notifying us of suspected unauthorized use. We may restrict, suspend, or terminate access to an account or feature when reasonably necessary for security, compliance, or enforcement of these Terms.

8. Forms and Communications

When you submit a form or property inquiry, you authorize Team Devine and, where appropriate, The Real Estate Studio to use the contact information you provide to respond to your inquiry by phone, email, or text. Submission does not guarantee a response, showing, appointment, service, property availability, or representation and does not create a brokerage or agency relationship.

If Team Devine later offers recurring or automated marketing calls or text messages, any additional consent language presented at the point of collection will apply to those communications. You do not need to agree to receive automated marketing messages as a condition of purchasing real estate services.

9. Intellectual Property

The Website’s original design, branding, logos, text, graphics, photographs, video, downloads, and other original content are owned by or licensed to Team Devine and are protected by applicable intellectual-property laws. MLS/IDX data, listing photographs, broker logos, third-party trademarks, and other third-party material remain the property of their respective owners and are used under applicable licenses or permissions.

Except for the limited right to view and use the Website as permitted by these Terms, no license or ownership right is granted. Written permission from the applicable rights holder is required before reproducing, modifying, distributing, republishing, selling, or commercially exploiting protected Website content.

10. Third-Party Services and Links

The Website may link to or use services provided by MLS participants, Realtyna/RealtyFeed, Google, Cloudflare, social networks, lenders, title companies, inspectors, and other third parties. We do not control and are not responsible for third-party content, products, services, availability, accuracy, privacy, security, or terms. A link, listing attribution, or reference does not necessarily constitute an endorsement.

Your use of a third-party website or service is governed by that third party’s terms and policies.

11. Disclaimer of Warranties

To the fullest extent permitted by law, the Website is provided on an “as is” and “as available” basis. Team Devine disclaims all warranties, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Website will be uninterrupted, error-free, secure, free from harmful components, or that defects will be corrected. Nothing in these Terms limits a warranty or right that cannot lawfully be excluded.

12. Limitation of Liability

To the fullest extent permitted by law, Team Devine, its team members, The Real Estate Studio, and their respective owners, agents, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, opportunities, or goodwill; or damages arising from Website use, inability to use the Website, reliance on Website or listing information, third-party services, transmission errors, malware, or unauthorized access.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Team Devine, its team members, The Real Estate Studio, and their respective owners, agents, employees, contractors, and service providers from claims, losses, liabilities, damages, judgments, and reasonable costs arising from your unlawful use of the Website, violation of these Terms, or infringement of another person’s rights.

14. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above identifies the latest revision. Continued use of the Website after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

15. Governing Law; Severability

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except when another law must apply. Any legal proceeding concerning these Terms or the Website must be brought in a court of competent jurisdiction, subject to any controlling agreement or law.

If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
